Law on Bonfires
Clarification is sometimes requested on the legal position for domestic bonfires on Theydon Grove. The District Council have advised us that there are no specific laws relating to domestic bonfires. Nuisance caused by bonfires is covered by the general powers contained within the Environmental Protection Act 1990, which basically means that unless the fire is causing a nuisance, from smoke or smell, there are no legal controls. The covenants for Theydon Grove do not specifically restrict bonfires, but they state Nothing shall be done or permitted to be done on the land which may be or grow to be a nuisance or annoyance to the owners of the adjoining or neighbouring properties.
The residents who overlook the areas maintain these two islands and have separately organised the upkeep and maintenance of the landscaping. Residents in these areas are asked to make as mall contribution to pay for the work. Should you require details please contact the Chairman who may be able to help you.
The reasons for these separate arrangements stems form the time when the estate developers had all the roads, footpaths and open areas adopted by the local authority. Had it not been for the timely actions of residents these islands would have been concreted. You are asked not to let children cycle, skate of play ball games on the grass on Esso Island or The Crescent in order to prevent deterioration in their appearance.
